Unternehmensvorschriften<\/strong><\/h1>\n

PRODUKTFRAGEN<\/strong>:<\/strong><\/p>\n

1. Vor der Bestellung kann der Kunde eine Anfrage zum Produkt an die E-Mail-Adresse biuro@siwatbombki.pl senden.<\/p>\n

\u201e\u015awiat Bombki\u201c nimmt keine telefonischen Anfragen zu Produkten entgegen.<\/p>\n

2. Nach dem Absenden der Anfrage erstellt \u201e\u015awiat Bombki\u201c innerhalb von 24 Stunden ein unverbindliches Angebot f\u00fcr die Anfrage, einschlie\u00dflich der Transportkosten, unter Angabe der G\u00fcltigkeitsdauer dieses Angebots.<\/p>\n

3. W\u00e4hrend der G\u00fcltigkeitsdauer der Bewertung ist der Kunde verpflichtet, eine Entscheidung zu treffen, nach Ablauf dieser Zeit ist die Bewertung veraltet und die darin angegebenen Preise k\u00f6nnen sich \u00e4ndern.<\/p>\n

4. Nach Annahme der Bewertung hat der Kunde das Recht, die Firma \u201e\u015awiat Bombki\u201c mit der Erstellung eines unverbindlichen und kostenlosen Entwurfs f\u00fcr ein\/e Schmuckst\u00fcck\/e zu beauftragen. Der Entwurf kann das Logo, Texte und Grafiken des Kunden enthalten.<\/p>\n

\u201e\u015awiat Bombki\u201c beh\u00e4lt sich das Recht vor, auf der eigenen Website Fotos des fertigen Produkts als Beispiel f\u00fcr die Umsetzung bereitzustellen.<\/p>\n

5. Das Unternehmen \u201e\u015awiat Bombki\u201c wird das Projekt innerhalb von 48 Stunden abschlie\u00dfen.<\/p>\n

\u201e\u015awiat Bombki\u201c beh\u00e4lt sich das Recht vor, die angegebene Frist im Falle einer sehr gro\u00dfen Anzahl von Anfragen zu verl\u00e4ngern.<\/p>\n

6. Nach Annahme des Entwurfs und der vorl\u00e4ufigen Bewertungen muss der Kunde eine offizielle Bestellung aufgeben.<\/p>\n

7.<\/strong> Sollte das Projekt nicht den Erwartungen des Auftraggebers entsprechen, besteht f\u00fcr den Auftraggeber die M\u00f6glichkeit, kostenfrei vom Vertrag zur\u00fcckzutreten.<\/p>\n

\u00a0<\/strong><\/p>\n

AUSF\u00dcHRUNG DER<\/strong> VERTRAG:
1. Der Kunde gibt seine Bestellung per E-Mail auf. \u201e\u015awiat Bombki\u201c akzeptiert keine telefonischen Bestellungen.<\/p>\n

2. Die Aufgabe einer Bestellung gilt als Annahme der Bewertung und der Grafik des Schmuckst\u00fccks, sofern diese vor der Bestellung erstellt wurde. \u201e\u015awiat Bombki\u201c weist darauf hin, dass die Grafik zur illustrativen Darstellung des Produkts erstellt wurde. Der Aufdruck des Schmuckst\u00fccks kann je nach Monitoreinstellungen geringf\u00fcgig von der Grafik abweichen.<\/p>\n

3. Der Kunde kann ein Muster seiner Bestellung anfertigen, um das tats\u00e4chliche Aussehen des Produkts zu pr\u00fcfen. Die Kosten f\u00fcr die Probebestellung werden individuell festgelegt. Nach Erhalt des Musters kann der Kunde Korrekturen in Form von \u00c4nderungen der Form oder Farbe des Drucks vornehmen.<\/p>\n

4. Der Kunde ist allein f\u00fcr die korrekte und eindeutige Angabe des Bestellgegenstands verantwortlich. Bei unklarem Inhalt der Bestellung haftet \u201e\u015awiat Bombki\u201c nicht f\u00fcr die Ausf\u00fchrung der Bestellung entgegen der Absicht des Kunden, sondern in \u00dcbereinstimmung mit dem Inhalt der Bestellung. Die Firma \u201e\u015awiat Bombki\u201c fertigt Kugeln an und bedruckt sie auf Kundenwunsch in Pantone-Farben.<\/p>\n

5. Die Aufgabe einer Bestellung bei \u201e\u015awiat Bombki\u201c ist gleichbedeutend mit der Annahme der Bestimmungen von \u201e\u015awiat Bombki\u201c.<\/p>\n

6.Der Kunde erkennt an, dass er die Waren gem\u00e4\u00df dem Warenmodell kauft, mit dem er sich vor der Bestellung vertraut machen konnte.<\/p>\n

7. Der Fertigstellungstermin wird jedes Mal neu festgelegt. \u201e\u015awiat Bombki\u201c informiert, dass der Fertigstellungstermin in der Regel 7\u201330 Tage nach der Projektgenehmigung und der Anzahlung betr\u00e4gt (der letzte dieser Termine z\u00e4hlt).<\/p>\n

8. Im Falle des R\u00fccktritts von einer bereits abgeschlossenen Bestellung erh\u00e4lt der Kunde keine R\u00fcckerstattung, da die Produkte f\u00fcr individuelle Bestellungen angefertigt werden. Lediglich die Transportkosten k\u00f6nnen storniert werden, wenn die Bestellung nicht an den Kunden versandt wird. \u201e\u015awiat Bombki\u201c weist darauf hin, dass der Kunde in jeder Produktionsphase das Recht hat, ein Foto anzufordern, das den aktuellen Produktionsschritt dokumentiert.
VERSAND VON WAREN ODER ABHOLUNG VON WAREN<\/strong><\/p>\n

1. Der Kunde kann die Ware nach vorheriger Vereinbarung eines Abholtermins pers\u00f6nlich abholen.<\/p>\n

2. Die Ware kann \u00fcber unsere Kurierdienste oder den Kurierdienst des Kunden versandt werden. \u201e\u015awiat Bombki\u201c \u00fcbernimmt jedoch keine Verantwortung f\u00fcr die Qualit\u00e4t des Lieferdienstes au\u00dferhalb unserer Kurierdienste. Im Falle einer Besch\u00e4digung der Ware verliert der Kunde das Recht, die Bestellung zu reklamieren.<\/p>\n

Unabh\u00e4ngig von der Wahl des Kurierunternehmens verpflichtet sich \u201e\u015awiat Bombki\u201c zur sorgf\u00e4ltigen und angemessenen Sicherung der Waren w\u00e4hrend des Transports.<\/p>\n

3. An den Kunden ausgegebene oder versandte Waren k\u00f6nnen nicht zur\u00fcckgegeben oder umgetauscht werden, au\u00dfer in den im Abschnitt \u201eBeschwerden\u201c genannten F\u00e4llen.<\/p>\n

4. Nimmt der Kunde die Sendung mit der Ware nicht ab und wird die Ware daher an den Absender \u201e\u015awiat Bombki\u201c zur\u00fcckgesandt, tr\u00e4gt er die Kosten f\u00fcr den R\u00fccktransport und die Kosten f\u00fcr den Transport einer neuen Warensendung. Gleichzeitig geht die Gefahr des zuf\u00e4lligen Untergangs und der Besch\u00e4digung der Ware in dem Moment auf den Kunden \u00fcber, in dem er die Ware vertragsgem\u00e4\u00df abholen sollte.<\/p>\n

Holt der Kunde die Ware nicht zum vereinbarten Termin pers\u00f6nlich ab<\/p>\n

\u201e\u015awiat Bombki\u201c kann \u2013 sofern m\u00f6glich \u2013 die Ware auf Kosten des Kunden in H\u00f6he von 1% des Bestellwertes f\u00fcr jeden Tag der Verz\u00f6gerung einlagern.<\/p>\n

Der Kunde verpflichtet sich, die Vertragsstrafe innerhalb von 7 Tagen ab Zahlungsaufforderung zu bezahlen.<\/p>\n

Auftragsbewertung<\/strong><\/p>\n

1. Jede Bestellung wird auf Grundlage der Preisliste bewertet, die dem Kunden nach vorheriger \u00dcberpr\u00fcfung zur Verf\u00fcgung gestellt wird. \u201e\u015awiat Bombki\u201c beh\u00e4lt sich das Recht vor, die Preisliste im Laufe des Jahres zu aktualisieren.<\/p>\n

2. Die Bewertung einer Bestellung, die nicht in der Preisliste enthalten ist, wird individuell erstellt. Jedes Angebot hat eine individuelle G\u00fcltigkeitsdauer, nach deren Ablauf sich das Angebot \u00e4ndern kann.<\/p>\n

3. Jedes Angebot enth\u00e4lt auch die aktuellen Transportpreise, die ebenfalls \u00c4nderungen unterliegen k\u00f6nnen.<\/p>\n

ZAHLUNGSBEDINGUNGEN<\/strong><\/p>\n

1.<\/strong> Die Zahlung kann auf zwei Arten erfolgen:<\/p>\n

A)<\/strong> Nach der Bestellung und vor deren Ausf\u00fchrung stellt \u201e\u015awiat Bombki\u201c eine Rechnung \u00fcber 100% des Bestellwerts aus<\/p>\n

ODER<\/strong><\/p>\n

B)<\/strong> Die Zahlung erfolgt in zwei Raten. Nach Auftragserteilung wird eine Anzahlungsrechnung ausgestellt, die 30-50% des Auftragswertes abdeckt und Grundlage f\u00fcr den Auftragsbeginn ist.<\/p>\n

Nach Abschluss der Bestellung, jedoch vor deren Versand, wird eine Schlussrechnung ausgestellt.<\/p>\n

Nach Zahlungseingang auf dem Konto wird die Ware versendet.<\/p>\n

2. Die Firma \u201e\u015awiat Bombki\u201c f\u00fchrt die Bestellung nicht ohne Vorauszahlung aus.<\/p>\n

und versendet keine Waren ohne die endg\u00fcltige Bezahlung.<\/p>\n

3. Das Unternehmen \u201e\u015awiat Bombki\u201c f\u00fchrt keine Nachnahmesendungen durch.<\/p>\n

4.Der Kunde stimmt zu, dass \u201e\u015awiat Bombki\u201c Rechnungen in elektronischer Form an die E-Mail-Adresse des Kunden sendet.<\/p>\n

\u00a0<\/strong><\/p>\n

BESCHWERDE<\/strong><\/p>\n

1.<\/strong> Das Unternehmen \u201e\u015awiat Bombki\u201c verpflichtet sich, jede Sendung sorgf\u00e4ltig zu sichern.<\/p>\n

Nach Erhalt der Ware hat der Kunde das Recht, die Ware zu pr\u00fcfen und festzustellen, ob Sch\u00e4den vorliegen.<\/p>\n

Im Falle einer Besch\u00e4digung der Sendung\/des Pakets verpflichtet sich der Kunde, im Beisein des Kuriers ein Schadensprotokoll zu erstellen, das als Grundlage f\u00fcr eine Reklamation der Bestellung dient. Der Kunde verpflichtet sich, Fotos, die den Schaden dokumentieren, an die E-Mail-Adresse biuro@swiatbombki.pl zu senden. Die Fotos werden der eingereichten Reklamation beigef\u00fcgt.<\/p>\n

2. Nur Waren, die als besch\u00e4digt oder nicht mit der Bestellung \u00fcbereinstimmend eingestuft werden, k\u00f6nnen reklamiert werden.<\/p>\n

3. M\u00e4ngel eines Teils der gelieferten Ware berechtigen nicht zur Beanstandung der gesamten bestellten Ware.<\/p>\n

4. Der Kunde ist verpflichtet, die bestellte Ware zu pr\u00fcfen und unverz\u00fcglich nach Erhalt zu reklamieren. sp\u00e4testens jedoch innerhalb von 5 Werktagen.<\/strong><\/p>\n

5. Im Falle des Versands von selbst an den Endkunden ist das Unternehmen \u201e\u015awiat Bombki\u201c nicht f\u00fcr Sch\u00e4den verantwortlich und akzeptiert diesbez\u00fcglich keine Reklamationen.<\/p>\n

6. Die Waren von \u201e\u015awiat Bombki\u201c werden individuell nach Ma\u00df gefertigt und unterliegen gem\u00e4\u00df den gesetzlichen Bestimmungen nicht der Reklamation, au\u00dfer bei Besch\u00e4digungen. Eine Ausnahme bildet ein deutlicher Unterschied zwischen dem genehmigten Entwurf und dem Endprodukt, beispielsweise das Fehlen eines Teils des Aufdrucks oder die Form des Aufdrucks, die vom Entwurf abweicht. Farbunterschiede zwischen Entwurf und Endprodukt sind nicht reklamationsf\u00e4hig. Diese Unterschiede k\u00f6nnen auf individuelle Monitoreinstellungen zur\u00fcckzuf\u00fchren sein. Um sich \u00fcber die Farbe des Aufdrucks zu vergewissern, kann der Kunde ein Muster des Produkts mit seinem individuellen Aufdruck bestellen oder kostenlose Muster mit Musterprojekten von \u201e\u015awiat Baubki\u201c anfordern.<\/p>\n

7. Die beanstandete Ware muss der Kunde auf eigene Kosten und nur nach vorheriger Absprache mit der Firma \u201e\u015awiat Bombki\u201c aufgrund der Reklamation zur\u00fccksenden.<\/p>\n

Nach Erhalt des beanstandeten Teils oder der gesamten Bestellung pr\u00fcft die Firma \u201e\u015awiat Bombki\u201c den Reklamationsgrund. Wird der Reklamationsgrund anerkannt, erstattet die Firma \u201e\u015awiat Bombki\u201c den f\u00e4lligen Betrag f\u00fcr die beanstandete Ware und in besonderen F\u00e4llen auch die Transportkosten. Auf Wunsch des Kunden und nach vorheriger Absprache mit ihm fertigt \u201e\u015awiat Bombki\u201c ein neues Produkt an und sendet es im Rahmen der Reklamation zur\u00fcck, ohne dass dem Kunden dadurch ein Schaden entsteht.<\/p>\n

Wenn die Reklamation unberechtigt ist, wird die Firma \u201e\u015awiat Bombki\u201c sie nicht anerkennen und den f\u00e4lligen Betrag f\u00fcr die Reklamation nicht bezahlen, und die reklamierte Ware wird entsorgt.<\/p>\n

8. Nach Ablauf der Frist von 5 Werktagen ab dem Datum des Warenerhalts erl\u00f6schen die Reklamationsrechte des Kunden.<\/p>\n

9. Die Antwort von \u201e\u015awiat Bombki\u201c zusammen mit der Best\u00e4tigung des Eingangs der Beschwerde erfolgt innerhalb von 3 Werktagen ab dem Datum des Eingangs.<\/p>\n

10. Die Beschwerde wird nicht ber\u00fccksichtigt, wenn:<\/p>\n

A)<\/strong> Die Reklamation betrifft Ware ohne Qualit\u00e4tsm\u00e4ngel<\/p>\n

B)<\/strong> nach Ablauf der in Nummer 4 genannten Fristen mitgeteilt wurde;<\/p>\n

C)<\/strong> Der Kunde hat sich nicht mit dem Produktmodell\/Muster des Produkts vertraut gemacht und reicht eine Reklamation ein, weil der tats\u00e4chliche Zustand des Produkts nicht seinen Erwartungen entspricht; dies gilt auch f\u00fcr Situationen, in denen die Ware ohne M\u00e4ngel nicht den Erwartungen des Kunden entspricht und der Kunde \u201e\u015awiat Bombki\u201c bei der Bestellung nicht dar\u00fcber informiert hat (insbesondere gilt dies f\u00fcr die Farbe des Aufdrucks).<\/p>\n

D)<\/strong> Der Kunde hat die Ware selbst oder durch Dritte besch\u00e4digt<\/p>\n

e)<\/strong> Die Waren unterscheiden sich geringf\u00fcgig in Farbe, Druckfarbe, Verpackung oder anderen Merkmalen von anderen Warenchargen, und diese Merkmale beeintr\u00e4chtigen nicht die Qualit\u00e4t oder Verwendbarkeit der Waren<\/p>\n

F)<\/strong> die Kennzeichnung erfolgte gem\u00e4\u00df dem vom Kunden genehmigten Entwurf;<\/p>\n

G)<\/strong> Die Reklamation betrifft minimale Farbunterschiede der Kennzeichnung innerhalb einer bestimmten Bestellung, die auf die Kennzeichnungstechnik (z. B. Drucken, Lasergravur) zur\u00fcckzuf\u00fchren sind, oder betrifft Unterschiede, die auf die Besonderheiten des Materials zur\u00fcckzuf\u00fchren sind, d. h. unterschiedliche Farben der Kugeln.<\/p>\n

11.<\/strong> Wenn die Beschwerde von \u201e\u015awiat Bombki\u201c angenommen wird:<\/p>\n

A)<\/strong> wird auf eigene Kosten eine neue Bestellung durchf\u00fchren,<\/p>\n

B)<\/strong> Wenn die Durchf\u00fchrung einer neuen Bestellung unm\u00f6glich (einschlie\u00dflich unrentabel) ist oder der Zeitpunkt ihrer Durchf\u00fchrung f\u00fcr den Kunden nicht angemessen ist, erstattet \u201e\u015awiat Bombki\u201c dem Kunden den Wert der beworbenen Waren zur\u00fcck.<\/p>\n

C)<\/strong> Mit Zustimmung des Kunden kann er auch den Preis der beworbenen Ware mindern, wobei der Kunde die Ware beh\u00e4lt und keine weiteren Reklamationen vornimmt.<\/p>\n

D)<\/strong> kann mit dem Kunden auch andere, oben nicht aufgef\u00fchrte Methoden zur Beilegung der Beschwerde vereinbaren.<\/p>\n

12. Durch die Einreichung einer Reklamation wird die Zahlungsfrist f\u00fcr die Ware weder unterbrochen noch ausgesetzt.<\/p>\n

13. \u201e\u015awiat Bombki\u201c versendet die beworbenen Waren auf eigene Kosten \u00fcber ein Kurierunternehmen<\/p>\n

INFORMATIONEN ZUR VERARBEITUNG PERSONENBEZOGENER DATEN<\/strong><\/p>\n

gem\u00e4\u00df Art. 13 der Verordnung (EU) 2016\/679 des Europ\u00e4ischen Parlaments und des Rates vom 27. April 2016 zum Schutz nat\u00fcrlicher Personen bei der Verarbeitung personenbezogener Daten und im Verfahren zum freien Datenverkehr (\u201eRODO<\/strong>\u201e), informieren \u00fcber den Umfang und die Grunds\u00e4tze der Datenverarbeitung personenbezogener Daten:<\/p>\n

1.<\/strong> Der <\/u><\/strong>A<\/u><\/strong>Administrator <\/u><\/strong>O<\/u><\/strong>F <\/u><\/strong>P<\/u><\/strong>pers\u00f6nlich <\/u><\/strong>D<\/u><\/strong>ata<\/u><\/strong> (<\/u><\/strong>AoPD<\/u><\/strong>)<\/u><\/strong> ist \u201e\u015awiat Bombki\u201c mit Sitz in Polen, NIP 517 016 33 53, mit einer Website www.christmasballswithlogo.com<\/p>\n

2.<\/strong> \u201e\u015awiat Bombki\u201c verarbeitet personenbezogene Daten zu folgenden Zwecken:<\/p>\n

\u2013 zur Vorbereitung, zum Abschluss und zur Durchf\u00fchrung eines Kaufvertrages oder Angebots<\/p>\n

\u2013 zum Zwecke der rechtm\u00e4\u00dfigen Aufbewahrung von Rechnungen und anderen Buchhaltungsunterlagen im Zusammenhang mit dem Verkauf oder Kauf<\/p>\n

\u2013 soweit dies zur Erf\u00fcllung der von AoPD oder den Datenempf\u00e4ngern verfolgten rechtlich begr\u00fcndeten Zwecke erforderlich ist, insbesondere zur Bereitstellung von Informationen \u00fcber AoPD-eigene Produkte oder Dienstleistungen, zur Geltendmachung von Anspr\u00fcchen aus der Gesch\u00e4ftst\u00e4tigkeit<\/p>\n

\u2013 um die gestellten Fragen zu beantworten<\/p>\n

\u00a03.<\/strong> Empf\u00e4nger personenbezogener Daten sind, soweit erforderlich, von AoDP zur Verarbeitung personenbezogener Daten erm\u00e4chtigte Personen sowie Unternehmen, die personenbezogene Daten im Auftrag von AoDP auf der Grundlage eines abgeschlossenen Vertrags verarbeiten und sich zur Einhaltung angemessener technischer und organisatorischer Ma\u00dfnahmen im Bereich des Schutzes personenbezogener Daten verpflichten, insbesondere Unternehmen, die f\u00fcr AoDP Dienstleistungen in den Bereichen IT, Personalwesen, Buchhaltung, Inkasso, Marketing, Transport und Wirtschaftspr\u00fcfung erbringen, sowie Postbetreiber. Soweit erforderlich, k\u00f6nnen wir Ihre personenbezogenen Daten an andere Unternehmen (Datenempf\u00e4nger) weitergeben, die f\u00fcr uns IT- und Inkassodienstleistungen erbringen. In Ausnahmesituationen k\u00f6nnen personenbezogene Daten auf Grundlage und im Rahmen der gesetzlichen Bestimmungen an befugte Beh\u00f6rden weitergegeben werden.<\/p>\n

4.<\/strong> Personenbezogene Daten werden so lange verarbeitet, wie es f\u00fcr die Bereitstellung personenbezogener Daten und die Vertragserf\u00fcllung erforderlich ist, sowie f\u00fcr den Kundendienst (z. B. Bearbeitung von Beschwerden), die Geltendmachung von Anspr\u00fcchen und die Erf\u00fcllung gesetzlicher Pflichten des AoDP (insbesondere in steuerlicher und buchhalterischer Hinsicht). Insbesondere bei K\u00e4ufen werden personenbezogene Daten f\u00fcr den Zeitraum gespeichert, der f\u00fcr die Durchf\u00fchrung und Abwicklung des Kaufvorgangs erforderlich ist, verl\u00e4ngert um die Verj\u00e4hrungsfrist f\u00fcr Anspr\u00fcche (gem\u00e4\u00df den Bestimmungen des B\u00fcrgerlichen Gesetzbuchs) und die Steuerabwicklung (d. h. einen Zeitraum von f\u00fcnf vollen Kalenderjahren ab dem Ende des Kalenderjahres, in dem die Steuerpflicht gem\u00e4\u00df dem Gesetz vom 11. M\u00e4rz 2004 \u00fcber die Steuer auf Waren und Dienstleistungen und dem Gesetz vom 29. August 1997 \u00fcber die Abgabenordnung erloschen ist). Im Falle eines Forderungseinzugs werden personenbezogene Daten bis zum Abschluss der Untersuchung oder Abwehr von Anspr\u00fcchen gem\u00e4\u00df dem B\u00fcrgerlichen Gesetzbuch und der Zivilprozessordnung verarbeitet. Personenbezogene Daten, die auf Grundlage einer gesonderten Einwilligung bereitgestellt werden, werden bis zu deren Widerruf verarbeitet.<\/p>\n

5.<\/strong> Der Kunde hat das Recht:<\/p>\n

\u2212 von AoDP den Zugriff auf ihre personenbezogenen Daten, deren Berichtigung, L\u00f6schung oder Einschr\u00e4nkung der Verarbeitung zu verlangen, der Verarbeitung dieser Daten zu widersprechen und die Daten unter den gesetzlich vorgesehenen und mit dem Verantwortlichen vereinbarten Bedingungen zu \u00fcbertragen,<\/p>\n

\u2212 Widerruf der Einwilligung zur Verarbeitung personenbezogener Daten (der Widerruf der Einwilligung ber\u00fchrt nicht die Rechtm\u00e4\u00dfigkeit der aufgrund der Einwilligung bis zum Widerruf erfolgten Verarbeitung),<\/p>\n

\u2212 Einreichen einer Beschwerde bei der Aufsichtsbeh\u00f6rde, in Polen der Pr\u00e4sident des Amtes f\u00fcr den Schutz personenbezogener Daten,<\/p>\n

PRODUCT QUESTIONS<\/strong>:<\/strong><\/p>

1. Before placing an order, the Customer may submit an Inquiry regarding the product to the e-mail address: biuro@siwatbombki.pl<\/p>

\u201c\u015awiat Bombki\u201d does not accept telephone inquiries about products.<\/p>

2.After sending the inquiry, \u201c\u015awiat Bombki\u201d will prepare a non-binding quotation of the Inquiry, including transport costs, within 24 hours, specifying the period of validity of this quotation.<\/p>

3. During the period of validity of the valuation, the customer is obliged to make a decision, after this time the valuation will be outdated and the prices given in it may change.<\/p>

4. After accepting the valuation, the customer has the right to order the \u201c\u015awiat Bombki\u201d company to make a non-committal and free project of a bauble \/ baubles. The project may contain the client\u2019s logo, text and graphics.<\/p>

\u201c\u015awiat Bombki\u201d reserves the right to provide photos of the finished product on its own website as an example of implementation.<\/p>

5.The company \u201c\u015awiat Bombki\u201d will complete the project within 48 hours.<\/p>

\u201c\u015awiat Bombki\u201d reserves the right to extend the given deadline in the event of a very large number of inquiries sent.<\/p>

6.After accepting the design and preliminary valuations, the Customer must place an official Order.<\/p>

7.<\/strong> If the project did not meet the client\u2019s expectations, the client has the option of resignation without incurring any costs.<\/p>

\u00a0<\/strong><\/p>

EXECUTION OF THE<\/strong> CONTRACT:
1. The Customer places an Order via e-mail. \u201c\u015awiat Bombki\u201d does not accept telephone orders.<\/p>

2.Placing an Order is tantamount to acceptance of the valuation and acceptance of the graphic design of the bauble, if it was made before placing the order. \u201c\u015awiat Bombki\u201d informs that the graphic design is made for the purpose of illustrative presentation of the product. The print on the bauble may differ slightly from the graphic design, as it depends on the individual monitor settings.<\/p>

3. The customer can make a sample of his order to see what the product actually looks like. The costs of the Trial Order are determined individually. After receiving a sample of the Order, the Customer may make corrections in the form of changing the shape or color of the print.<\/p>

4.The Customer is solely responsible for the correct and unambiguous specification of the subject of the Order. In the case of ambiguous content of the Order, \u201c\u015awiat Bombki\u201d is not responsible for the execution of the Order contrary to the Customer\u2019s intention, but in a manner consistent with the content of the Order. The company \u201c\u015awiat Bombki\u201d makes baubles and prints on baubles in Pantone colors at the customer\u2019s request.<\/p>

5. Placing an Order in \u201c\u015awiat Bombki\u201d is tantamount to accepting the Regulations of \u201c\u015awiat Bombki\u201d.<\/p>

6.The Customer acknowledges that he purchases the Goods according to the Goods Model, which he could get acquainted with before placing the Order.<\/p>

7.The completion date is set each time. \u201c\u015awiat Bombki\u201d informs that the completion date is usually this 7-30 days from project approval and advance payment (the last of these dates counts).<\/p>

8. In the event of resignation from an already completed Order, the Customer will not receive a refund, because the products are made for individual Orders. Only the cost of transport may be canceled in the event of refusal to send the Order to the Customer. \u201c\u015awiat Bombki\u201d informs that at each stage of production, the customer has the right to ask for a photo documenting the current stage of production.
SHIPMENT OF GOODS OR COLLECTION OF GOODS<\/strong><\/p>

1. The customer can pick up the goods in person after prior arrangement of the pick-up date.<\/p>

2.The goods can be sent via our courier companies or via the customer\u2019s courier company. However, \u201c\u015awiat Bombki\u201d is not responsible for the quality of the delivery service outside our courier companies and in the event of damage to the goods, the Customer loses the possibility to complain about the Order.<\/p>

Regardless of the choice of the courier company, \u201c\u015awiat Bombki\u201d undertakes to carefully and adequately secure the goods during transport.<\/p>

3.Goods issued or sent to the Customer are not subject to return or exchange, except for the cases specified in the \u201cComplaints\u201d section<\/p>

4. If the Customer fails to collect the shipment with the goods, which will result in returning the goods to the sender \u201c\u015awiat Bombki\u201d, the Customer will be charged with the costs of return transport and the costs of transporting a new shipment of goods. At the same time, the risk of accidental loss and damage to the Goods passes to the Customer at the moment when, in accordance with the contract, the Customer was to collect the goods.<\/p>

If the customer does not pick up the goods in person at the agreed time<\/p>

\u201c\u015awiat Bombki\u201d \u2013 if possible \u2013 can store the goods at the customer\u2019s expense in the amount of 1% of the order value for each day of delay.<\/p>

The customer undertakes to pay the contractual penalty within 7 days from the date of the request for payment.<\/p>

ORDER VALUATION<\/strong><\/p>

1. Each order is valued on the basis of the price list, which will be provided to the customer after prior verification. \u201c\u015awiat Bombki\u201d reserves the right to update the price list during the year.<\/p>

2.The valuation of an order that is not included in the price list will be prepared individually. Each quote has an individual validity period, after which the quote may change.<\/p>

3.Each quote also includes current transport prices, which are also subject to change.<\/p>

TERMS OF PAYMENT<\/strong><\/p>

1.<\/strong> Payment can be made in two ways:<\/p>

a)<\/strong> After placing the order, and before its implementation, \u201c\u015awiat Bombki\u201d will issue an invoice for 100% of the order value<\/p>

OR<\/strong><\/p>

b)<\/strong> Payments will be made in two tranches. After placing the order, an advance invoice will be issued, which covers 30-50% of the order value and is the basis for starting the order.<\/p>

After completing the order, but before its shipment, a final invoice will be issued.<\/p>

After the payment is credited to the account, the goods will be sent.<\/p>

2. The company \u201c\u015awiat Bombki\u201d does not proceed to the execution of the order without an advance payment<\/p>

and does not ship goods without final payment.<\/p>

3.The company \u201c\u015awiat Bombki\u201d does not carry out cash on delivery shipments.<\/p>

4.The Customer agrees that \u201c\u015awiat Bombki\u201d sends invoices in electronic form to the Customer\u2019s e-mail address.<\/p>

\u00a0<\/strong><\/p>

COMPLAINT<\/strong><\/p>

1.<\/strong> The \u201c\u015awiat Bombki\u201d company undertakes to carefully secure each shipment.<\/p>

After receiving the goods, the customer has the right to check the goods and determine whether they are damaged.<\/p>

In the event of damage to the shipment\/package, the Customer undertakes to draw up a damage report in the presence of the courier, which will be the basis for a complaint about the order. The customer undertakes to send to the e-mail address biuro@swiatbombki.pl photos documenting the fact of damage. Photos will be attached to the submitted complaint.<\/p>

2. Only goods classified as damaged or inconsistent with the Order are subject to a complaint.<\/p>

3. Defects of a part of the delivered Goods do not entitle to a complaint of the entire ordered Goods.<\/p>

4. The Customer is obliged to check the ordered Goods and submit a complaint immediately after receiving it, but not later than within 5 working days.<\/strong><\/p>

5. In the event that it sends from itself to the end customer, the company \u201c\u015awiat Bombki\u201d is not responsible for any damage and does not accept complaints in this regard.<\/p>

6. \u201c\u015awiat Bombki\u201d goods are made to individual order and, in accordance with the law, are not subject to complaint in cases other than damage. The exception is a glaring difference between the approved design and the final product, which may be, for example, the lack of part of the print or the print in a shape different from the design. The difference in the color of the print between the project and the final product is not subject to complaint. This difference may be due to individual monitor settings. To be sure about the color of the print, the customer can order a sample of the product with his own custom print or ask for free samples with sample projects \u201c\u015awiat Baubki\u201d.<\/p>

7. The Goods under complaint should be returned by the Customer at his own expense and only after prior agreement with the \u201c\u015awiat Bombki\u201d company on the basis of the complaint.<\/p>

After receiving the advertised part of the order or the entire order, the \u201c\u015awiat Bombki\u201d company will verify the grounds for the complaint. If the basis for the complaint is accepted, the \u201c\u015awiat Bombki\u201d company will return the amount due for the advertised goods and in special cases will also return the transport costs or, at the customer\u2019s request and after prior agreement with the customer, \u201c\u015awiat Bombki\u201d will make a new product and send it back as part of the complaint without incurring any loss by the customer.<\/p>

If the complaint is unjustified, the company \u201c\u015awiat Bombki\u201d will not recognize it and will not pay the amount due for the complaint, and the claimed goods will be disposed of.<\/p>

8. After the expiry of the period of 5 working days from the date of receipt of the shipment, the Customer\u2019s rights under the complaint expire.<\/p>

9. The reply from \u201c\u015awiat Bombki\u201d along with confirmation of receipt of the complaint will be provided within 3 working days from the date of its receipt.<\/p>

10. The complaint will not be considered when:<\/p>

a)<\/strong> The complaint concerns goods without quality defects<\/p>

b)<\/strong> has been notified after the expiry of the time limits set out in point 4;<\/p>

c)<\/strong> the customer has not familiarized himself with the product model \/ sample of the product and submits a complaint due to the non-compliance of his expectations with the actual state of the product; this also applies to situations where goods without defects do not meet the Customer\u2019s expectations, of which the Customer did not inform \u201c\u015awiat Bombki\u201d when placing the Order (in particular, this applies to the color of the print)<\/p>

d)<\/strong> The customer has damaged the goods himself or through third parties<\/p>

e)<\/strong> The Goods slightly differ in color, color of the print, packaging or other features from other lots of the Goods, and these features do not affect the quality or usability of the Goods<\/p>

f)<\/strong> the marking was made in accordance with the design approved by the client;<\/p>

g)<\/strong> the complaint concerns the minimum color differences of the marking within a given Order resulting from the marking technique such as printing, laser engraving or concerns differences resulting from the specificity of the material, i.e. different colors of baubles.<\/p>

11.<\/strong> If the \u201c\u015awiat Bombki\u201d complaint is accepted:<\/p>

a)<\/strong> will perform a new order at its own expense,<\/p>

b)<\/strong> if the implementation of a new order would be impossible (including unprofitable) or the time of its implementation would not be appropriate for the customer, \u201c\u015awiat Bombki\u201d will return the value of the advertised goods to the customer<\/p>

c)<\/strong> with the consent of the Customer, it may also reduce the price of the advertised goods, while the Customer retains the goods and will not make any further complaints.<\/p>

d)<\/strong> may also agree with the Customer other methods of settling the complaint, not listed above.<\/p>

12. Filing a complaint does not interrupt or suspend the payment deadline for the goods.<\/p>

13. \u201c\u015awiat Bombki\u201d sends the advertised goods at its own expense via a courier company<\/p>

INFORMATION ON THE PROCESSING OF PERSONAL DATA<\/strong><\/p>

in accordance with Art. 13 of Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and in the procedure of the free movement of such data (\u201cRODO<\/strong>\u201c), provide information on the scope and principles of data processing personal:<\/p>

1.<\/strong> The <\/u><\/strong>A<\/u><\/strong>dministrator <\/u><\/strong>o<\/u><\/strong>f <\/u><\/strong>P<\/u><\/strong>ersonal <\/u><\/strong>D<\/u><\/strong>ata<\/u><\/strong> (<\/u><\/strong>AoPD<\/u><\/strong>)<\/u><\/strong> is \u201c\u015awiat Bombki\u201d based in Poland, NIP 517 016 33 53, having a website www.christmasballswithlogo.com<\/p>

2.<\/strong> \u201c\u015awiat Bombki\u201d processes personal data for the following purposes:<\/p>

\u2013 in order to prepare, conclude and perform a sales contract or offer<\/p>

\u2013 for the purpose of lawfully storing invoices and other accounting documents related to the sale or purchase<\/p>

\u2013 to the extent necessary to fulfill legally justified purposes pursued by AoPD or data recipients, in particular for the purpose of providing information about AoPD own products or services, pursuing claims for business activity<\/p>

\u2013 in order to answer the questions asked<\/p>

\u00a03.<\/strong> The recipients of personal data will be, to the extent necessary, persons authorized by AoDP to process personal data and entities processing personal data on behalf of AoDP on the basis of a concluded agreement obliging to maintain appropriate technical and organizational measures in the field of personal data protection, in particular they will be entities providing AoDP with services IT, HR, accounting, debt collection, marketing, transport and auditing as well as postal operators. To the extent necessary, we may transfer your personal data to other entities (data recipients) that provide IT and debt collection services for us. In exceptional situations, personal data may be transferred to authorized public authorities on the basis of and within the limits of the law.<\/p>

4.<\/strong> Personal data will be processed for the time necessary to achieve the purposes of providing personal data and performing the contract, and also for the time necessary for after-sales service (e.g. handling complaints), pursuing claims and for the time necessary to fulfill AoDP obligations under the law (in particular tax and accounting). In particular, in the case of purchases, personal data will be stored for the period needed to complete and settle the sales process, extended by the period of limitation of claims (in accordance with the provisions of the Civil Code) and tax settlement (i.e. a period of 5 full calendar years from the end of the calendar year in which the tax obligation has expired, in accordance with the Act of 11 March 2004 on tax on goods and services and the Act of 29 August 1997 Tax Ordinance). In the event of debt collection, personal data will be processed until the end of the investigation or defense against claims in accordance with the Civil Code and the Code of Civil Procedure. Personal data provided on the basis of a separate consent will be processed until its withdrawal.<\/p>

5.<\/strong> The customer has the right to:<\/p>

\u2212 request AoDP to access their personal data, rectify, delete or limit processing, object to the processing of such data and transfer data under the conditions resulting from the law and agreed with the data controller,<\/p>

\u2212 withdrawal of consent to the processing of personal data (withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal),<\/p>

\u2212 lodging a complaint to the supervisory body, which in Poland is the President of the Office for Personal Data Protection,<\/p>

\u2212 impact on the scope of processed data (including in particular through human contact with AoDP and expressing one\u2019s own position).<\/p>
